AGREEMENT AND DISCLOSURE STATEMENT FOR ELECTRONIC WEBSITE PAYMENT SERVICES
This Agreement and Disclosure Statement for electronic payments to QAC (Quality Acceptance Corp., and/or Southeastern Finance Corp, dba Auto Select) from our website autoselect123.com, (the "Agreement") sets forth the terms and conditions for use of our online and electronic payment services, as described herein. You should read this Agreement carefully and keep an electronic or hard copy of it with your records. By using any electronic sounds, symbols, or processes we provide in order to establish your acceptance of this Agreement and/or other terms and conditions related to the Agreement, you acknowledge and agree that you are using an electronic signature to signify your intent to be bound, and you agree to do business with us and exchange information electronically, as provided in this Agreement and as we may direct. Each time you use any Service described in this Agreement, or allow any other person to use any Service in relation to any of your accounts or financial products or services, you are confirming your acceptance of the terms of this Agreement (including, but not limited to, the terms of that particular Service) that are in effect at that time.
ARBITRATION AND WAIVER OF JURY TRIAL. THIS AGREEMENT CONTAINS PROVISIONS FOR BINDING ARBITRATION AND WAIVER OF JURY TRIAL. YOUR ACCEPTANCE OF THIS AGREEMENT INCLUDES YOUR ACCEPTANCE OF AND AGREEMENT TO SUCH PROVISIONS. WHEN ARBITRATION IS INVOKED FOR CLAIMS SUBJECT TO ARBITRATION, YOU AND WE WILL NOT HAVE THE RIGHT TO PURSUE THAT CLAIM IN COURT OR HAVE A JURY DECIDE THE CLAIM, AND YOU WILL NOT HAVE THE RIGHT TO BRING OR PARTICIPATE IN ANY CLASS ACTION OR SIMILAR PROCEEDING IN COURT OR IN ARBITRATION.

Cancelling or Changing a Payment made online. You may cancel or change any Payment that has begun processing by following these instructions. Once the Service has processed a Payment, you cannot cancel or edit the Payment using this Service, you must call us during our normal operating hours and request a change or cancelation of your payment made online. Please note that a payment void or cancelation my take up to 72 hours or 3 business days to take effect.
Most Payments cannot be stopped once processing has begun. For Payments to be stopped, we must receive your stop payment request in sufficient time to allow the Payment to be cancelled, which generally will be at least three (3) business days. If we are unable to stop your Payment, the Payment will be processed according to your original instructions for the Payment, and we will have no liability for failing to stop the online Payment, subject to the requirements of applicable law. Stop payment requests are subject to applicable fees and charges as provided in the agreement and disclosures governing your Installment Sale Contract or your Loan Account.
Updating Information. It is solely your responsibility to obtain and maintain all account names and or account numbers required by you to make your auto loan payments on Auto Select’s website. You cannot make changes to this information using the Service, and you must contact Quality Acceptance Corp. directly to make any changes.
Mobile Banking Service Limitations.
a. Loss of Data. Neither we nor our service providers can always foresee or anticipate technical or other difficulties related to the website payment Service. These difficulties may result in loss of data, personalization settings or other Service interruptions. Neither we nor any of our service providers assumes responsibility for the timeliness, deletion, misdelivery, communications or personalization settings in connection with your use of the payment Service.
b. Operational Availability. Neither we nor any of our service providers assumes responsibility for the operation, security, functionality or availability of any Wireless Device or mobile network which you utilize to access the Mobile website payment Service.
c. Errors and Delays. Financial information obtained through the website payment Service (including, without limitation, any text message alerts) reflects the most recent account information available through the Service and may not be accurate or current. You agree that neither we nor our service providers will be liable for any errors or delays in the content, or for any actions taken in reliance thereon. Certain features, functions, and services available through other payment Services or at our Online payment Service website may not be available using the Mobile Banking Service.
